Terms and conditions.

1. Who we are

The site and portal are operated by Euan Livingstone, trading as Euan Livingstone Web Design & Development Services, based in Dunfermline, Scotland. Contact: hello@euanliv.click.

2. The website

The public portfolio is provided for information about services, work and how to get in touch. Content is offered in good faith but may change without notice. Nothing on the public site is a binding offer unless confirmed in writing or via a signed agreement.

3. Client portal

The client portal is invite-only. There is no public registration. Accounts are created when you are invited by Euan Livingstone or an organisation administrator.

• You must keep login details secure and tell us promptly if you suspect unauthorised access.
• You may only use the portal for legitimate business relating to your organisation’s engagement with Euan Livingstone.
• Access may be suspended or withdrawn if these terms are breached, an invitation expires unused, or an engagement ends.
• Features may include project status, invoices and billing (via Stripe), contracts for signature, maintenance requests and account settings. Availability can change as the portal develops.

4. Acceptable use

You must not:

• Attempt to access another user’s account or data
• Probe, scrape or overload the site or portal beyond normal use
• Upload unlawful, harmful or misleading content where uploads are available
• Use the portal in a way that harms Euan Livingstone, other clients or third-party services (including Stripe or hosting providers)

5. Projects, fees and contracts

Individual project work, hosting, maintenance and related services are governed by the specific agreement, proposal or contract issued for that engagement (including any portal contract for signature). Those documents take precedence over these website terms for the services they cover. Fees, deposits, timelines and deliverables are as stated in that agreement or in Stripe billing set up for your organisation. See also the Refunds and cancellations policy.

6. Intellectual property

Portfolio content, branding and site design belong to Euan Livingstone unless otherwise stated. Client project ownership and licences are set out in the relevant project agreement. Do not copy or reuse site materials without permission.

7. Third-party services

The site and portal may rely on third parties such as Cloudflare (hosting and analytics), Stripe (payments), MailerSend (email) and hosting affiliates. Their terms and privacy practices apply to their processing. We are not responsible for outages or failures outside reasonable control.

8. Liability

To the extent permitted by Scots law, Euan Livingstone is not liable for indirect or consequential loss arising from use of the public site or portal. Nothing in these terms excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or fraud). Project-specific liability caps in signed agreements apply to those services.

9. Privacy

How personal data is handled is described in the Privacy policy. Cookie and similar storage is covered in the Cookies policy. All policies are listed on the Legal page.

10. Changes

These terms may be updated from time to time. The “Last updated” date at the top will change when they do. Continued use of the site or portal after changes means you accept the updated terms.

11. Governing law

These terms are governed by the law of Scotland. Courts of Scotland have exclusive jurisdiction, except where mandatory consumer protections require otherwise.
